The General Contracting Conditions regulate the distance selling relationship between TRISQUEL ARTESANIA SC and the user or client, in accordance with the legal stipulations, especially Law 7/1998, of April 13, on General Contracting Conditions, the Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of consumers and Users, Organic Law 3/2018, of December 5, of Protection of Personal Data and guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Company Services of the Information and Electronic Commerce.

TRISQUEL ARTESANIA SC reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. Said modifications may be made, through their websites, by any form admissible by law and shall be binding during the time they are published on the web and until they are validly modified by subsequent ones. However, TRISQUEL ARTESANIA SC reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems it appropriate, announcing them in a timely manner.

Prices

All products indicate the sale price in Euros and include Value Added Tax (VAT).

If any other tax is applicable, this will be indicated (IGIC or IPSI).

Delivery and transport costs

TRISQUEL ARTESANIA SC only makes shipments charging an additional amount in Euros, for shipping costs.

This form of payment is valid only on the web.

When the amount of a purchase has been charged fraudulently or improperly using the number of a payment card, its holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and reimbursement annotations in the accounts of the supplier and the holder will be made as soon as possible.

However, if the purchase had actually been made by the cardholder and the demand for return was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had improperly demanded the cancellation of the corresponding charge, it will remain liable to TRISQUEL ARTESANIA SC to compensate for damages caused as a result of said cancellation. 

Wire transfer

When selecting the bank transfer, you will receive, together with the confirmation of your order, an e-mail with the bank details of TRISQUEL ARTESANIA SC.

It is very important that when making the transfer you indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days after the order confirmation date in order to validate it.

Remind you that the payment has to be made in EUROS and that all eventual exchange and banking commissions are at your own expense.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions at origin, those bank commissions and expenses corresponding to your entity. Otherwise, TRISQUEL ARTESANIA SC could paralyze the shipment of your order by not receiving the full amount of it.

Possible exchange and banking commissions are borne by the client.

Order execution

TRISQUEL ARTESANIA SC undertakes to deliver the order in a maximum of 5 business days in the peninsula, from the day after the order.

The availability of the products offered by TRISQUEL ARTESANIA SC may vary depending on customer demand. Although TRISQUEL ARTESANIA SC updates the stock periodically, the product requested by the client could be out of stock at that time. In the event of non-execution due to unavailability, TRISQUEL ARTESANIA SC will notify the client by e-mail as soon as it becomes aware of this situation. The period of this communication will not exceed in any case the maximum period of 30 days. TRISQUEL ARTESANIA SC may give the double option of: supplying the customer without price increase, a product with similar characteristics, or except for justified and demonstrable reasons by TRISQUEL ARTESANIA SC within this same period, pay the amounts paid for the canceled order.

Right of withdrawaL

The buyer will have a period of fourteen calendar days to withdraw, from the day the customer receives the product, without any penalty and without indicating the reasons.

The exercise of the right of withdrawal must be done by means of a notification by telephone to 981 576 870, by sending an email to trisquelartesania@trisquelartesania.com, sending your letter to our postal address ACIBECHERIA Nº31 15704, SANTIAGO DE COMPOSTELA (A CORUÑA), or through of the withdrawal form.

As established in article 103 of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of consumers and Users, the supplies of services or goods made in accordance with the specifications of the consumer or clearly personalized, or that, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

Return

TRISQUEL ARTESANIA SC will not be responsible for collecting the product.

The customer must return or deliver the product directly to TRISQUEL ARTESANIA SC, at the address ACIBECHERIA Nº31 15704, SANTIAGO DE COMPOSTELA (A CORUÑA), without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right of withdrawal from the contract is formalized. The term will be understood as fulfilled if the customer returns the product before the end of the term.

TRISQUEL ARTESANIA SC will not be responsible for the costs of the return, these being the responsibility of the client. The return of the product must include the original labels, seals, accessories and packaging. The returned product will not be accepted in the event that it contains marks or stains of makeup, chemical products or any other type of product, as well as scratches or marks, as well as the return of products that include some degree of personalization or parts modified at the customer's request.

The customer will be responsible for the costs of returning the product.

Payment refund

The reimbursement of the amounts received by the client will be made using the same means of payment used by the client, as long as the opposite has not been provided.

TRISQUEL ARTESANIA SC will pay the amounts paid by the client within 14 calendar days from the date of receipt of the right of withdrawal.

TRISQUEL ARTESANIA SC may retain the refund until the product has been received, reason for withdrawal, or until the customer provides proof of return, depending on which condition is met first.

Return of the defective product

In the event that the product is not in good condition and the causes attributable to it are not a consequence of the customer, the customer will have the right to return the product, informing TRISQUEL ARTESANIA SC of the reason for return through any of the means provided in these contracting conditions, and at no cost to the client. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.

TRISQUEL ARTESANIA SC undertakes to assume the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.

Jurisdiction

Likewise, TRISQUEL ARTESANIA SC reserves the right to file civil or criminal actions that it deems appropriate for the improper use of its website and contents or for the breach of these conditions.

The relationship between the user and the provider will be governed by current regulations and applicable in the Spanish territory. If any controversy arises, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
